By accessing or using Gistia's lab informatics managed services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Service Description

Gistia provides lab informatics managed services including:

  • Lab Informatics Managed Services
  • Gistia Cloud LIMS
  • Lab Metrics BI-as-a-Service
  • Custom laboratory workflow optimization
  • HIPAA-compliant data management solutions

3. Subscription Terms

Our services are provided on a subscription basis at $4,995 per month per service. Key terms include:

  • Monthly billing cycle with 30-day payment terms
  • 48-72 hour turnaround for service requests
  • Unlimited requests within scope of subscribed services
  • No vendor lock-in - cancel anytime with 30-day notice
  • Continuous enhancement and optimization included

4. User Responsibilities

You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Use our services only for lawful purposes
  • Comply with all applicable healthcare regulations
  • Notify us promptly of any security incidents

5. Data Security and Compliance

We maintain HIPAA-compliant systems and procedures to protect your data. Our security measures include:

  • End-to-end encryption for data transmission and storage
  • Regular security audits and penetration testing
  • Role-based access controls and comprehensive audit trails
  • Business Associate Agreement (BAA) compliance
  • 24/7 security monitoring and incident response

6. Service Level Agreement

We commit to:

  • 99.9% uptime for core services
  • 48-72 hour response time for service requests
  • Dedicated support during business hours (8 AM - 6 PM EST)
  • Emergency support for critical system issues
  • Monthly performance reports and optimization recommendations

7. Intellectual Property

All intellectual property rights in our services, software, and documentation remain our property. You retain ownership of your data and may export it at any time.

8. Limitation of Liability

To the maximum extent permitted by law, Gistia shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.

9. Termination

Either party may terminate the subscription with 30 days written notice. Upon termination, you will have 90 days to export your data before it is securely deleted.
